Property Registration in the Land Department of Thailand: A Guide for Owners

Congratulations! You have become the proud owner of property in Thailand!

To register the property in your name, you need to complete the process at the Land Department of Thailand. You do not need to visit the department in person or go through the entire procedure yourself. You can issue a power of attorney to a third party who will register the property on your behalf. This third party can be your agent, lawyer, developer, or a trusted friend.

How to Issue a Power of Attorney for Property Registration in Thailand

To issue a Power of Attorney for property registration at the Land Department, follow these steps:

  1. Consult a Lawyer. Find a lawyer who will prepare all the necessary documents for property registration in Thailand.
  2. Prepare the Required Documents. Your lawyer will need:
    • Copies of the passports of the property owner and the authorized representative.
    • The exact address of the property.
    • Information about the acquired property: unit number, area, floor, etc. (You can provide the lawyer with the contract so they can extract the necessary details).
    • The validity period of the power of attorney.
    • The authority of the representative (for example, if their task is solely to complete the transaction at the Land Department, this must be specified in the Power of Attorney).
  3. Sign the Power of Attorney. Once the power of attorney is ready, both the owner and the authorized representative must sign it in person. If the owner is outside of Thailand, the original document must be sent abroad for signing and then returned to the lawyer.

Notifying the Developer

After preparing the power of attorney, the developer must be notified. The property owner must write an official letter stating that the authorized representative will handle the registration at the Land Department. The letter should include:

  • The full name of the authorized representative.
  • The date of birth of the authorized representative.
  • A copy of the authorized representative’s passport.

What is Required for Property Registration at the Land Department

When registering property at the Land Department, you must provide:

  • The Power of Attorney.
  • Signed sales and purchase agreements. Note that these agreements must be signed personally by the property owner, not the authorized representative. The developer usually prepares the contract.
